Regulation (EU) 2026\/1828 of 28 July 2026 has just been published, amending Regulation (EU) 2023\/915 as regards maximum levels of delta-9-tetrahydrocannabinol (\u03949-THC) in hemp leaves for water infusion and in hemp leaf infusions<\/a><\/strong>.<\/p>

Regulation (EU) 2023\/915 already established maximum levels for the sum of \u03949-THC and \u03949-THCA, expressed as \u03949-THC equivalents, in hemp seeds and derived products<\/strong>; however, such levels had yet to be set for hemp leaves intended for water infusions <\/strong>and for ready to drink hemp leaf infusions<\/strong>, which are also listed as permitted in the Novel Food Catalogue.<\/p>

The lipophilic nature of \u03949-THC and \u03949-THCA must be taken into account, as it limits their migration into a water-based infusion; conversely, adding a fatty ingredient\u2014such as cream or milk\u2014during the steeping process produces the opposite effect. Therefore, it is important to note that the fatty ingredient should only be added after the steeping stage. <\/p>

Foods legally marketed before 1 January 2027, the date of application of this Regulation, may remain on the market until their date of minimum durability or use-by date.<\/p>

The maximum limits for \u03949-THC would be as follows:<\/p>

Maximum limit: 40 mg\/kg<\/p>

The following statements shall be included in the main visual field of the label:<\/p>

\u2014 Only to be used for water infusion (preparation of a herbal infusion).<\/p>
